In January 2026, the FBI executed a search warrant at the Fulton County Election Hub, seizing nearly 700 boxes of 2020 election records. The Justice Department maintains the raid is part of a lawful criminal investigation into alleged deficiencies in how the county retained and tabulated ballots, specifically citing “duplicate ballots” and missing scans.
Fulton County officials and independent experts argue the raid was an unconstitutional seizure. They contend the search warrant affidavit relied on glaring misunderstandings of the process and long-debunked theories from individuals who now hold positions in the White House. During recent federal court hearings, the county explained that the alleged “defects” were minor administrative inconsistencies, such as internal tally marks or routine mechanical rescans for jammed machines, none of which constitute fraud.
The legal fight remains highly active across multiple fronts. In federal court, Fulton County is demanding the return of the original ballots. The DOJ has offered to return the originals after making copies but insists on keeping the data for its probe. An upcoming evidentiary hearing will likely force the FBI agent who drafted the affidavit to testify.
Concurrently, the Lawyers’ Committee for Civil Rights Under Law filed a parallel civil suit on behalf of the NAACP. They aim to restrict the DOJ from using the seized personal voter data outside the specific criminal investigation, warning the Trump administration might misuse the data or intimidate voters. The DOJ has moved to dismiss this motion, calling it a delay tactic.
Tulsi Gabbard’s Role
Director of National Intelligence Tulsi Gabbard was present during the January raid. In a letter to Congress, she stated she attended at President Trump’s request and under her broad statutory authority regarding election security. She also confirmed she facilitated a phone call between President Trump and the FBI agents on site to thank them for their work, though she insisted no directives were issued. Her presence drew intense scrutiny, as the raid was a domestic law enforcement action, not a foreign intelligence operation.
Gabbard is currently a central figure in the Trump Administration but faces fresh controversy. Speculation is mounting that she may be forced to resign amid intense internal disagreements over the administration’s policy regarding the ongoing Iran conflict. Despite this pressure, she remains active, recently releasing reports explicitly naming former President Barack Obama and top Obama-era intelligence officials in an alleged coordinated plan to undermine Donald Trump’s 2016 election win.
