The CLARITY Act BOMBSHELL: XRP is Safe, but Flare Faces the Ultimate Test!

The proposed Digital Asset Market Clarity Act (CLARITY Act) seeks to end the regulatory tug-of-war in the U.S. by dividing oversight between the SEC (for securities) and the CFTC (for commodities) based on an asset’s utility and decentralization.

Because XRP and Flare (FLR) serve fundamentally different purposes, the legislation treats their use cases entirely differently.

Here is how Flare’s utility will be treated in contrast to XRP if the legislation passes:

 

XRP: The Digital Commodity for Settlement

  • The Use Case: XRP is intrinsically linked to the XRP Ledger and is designed primarily as a bridge currency for high-speed, low-cost cross-border payments and institutional settlement. It does not natively run smart contracts or offer protocol-level yield.
  • The CLARITY Act Impact: The Act seeks to permanently codify digital commodities under the exclusive jurisdiction of the CFTC. Because XRP already received a 2023 court ruling and a March 2026 joint SEC/CFTC interpretive release classifying it as a digital commodity, the CLARITY Act would cement that status in federal law. This clears the runway for XRP to be used legally and freely as an institutional payment rail, custody asset, and ETF holding without fear of future SEC enforcement.

Flare (FLR): The DeFi and Smart Contract Infrastructure

  • The Use Case: Flare is an EVM-compatible Layer-1 network built to provide decentralized data (oracles) and bring smart contracts to networks like XRP. Its utility inherently involves Decentralized Finance (DeFi)…users wrap, stake, and delegate their FLR tokens to data providers to earn yield-like rewards.

 

  • The CLARITY Act Impact: Because Flare’s use case relies on yield generation and decentralized software, it faces strict hurdles that XRP avoids:

 

    • The “Mature Blockchain” Test: To be classified as a CFTC-regulated commodity like XRP, Flare must pass the Act’s decentralization test. It has to prove that no centralized foundation or small group of developers retains meaningful control over the network or its token supply.

 

    • DeFi and Yield Scrutiny: The Act heavily scrutinizes assets that offer financial returns. Flare’s ecosystem of delegation rewards means it must navigate the Act’s DeFi provisions, which force protocols to either prove they are genuinely decentralized or face regulation as a financial intermediary. Fortunately for Flare’s ecosystem, the revised Senate draft of the bill does include specific protections for non-custodial developers building these decentralized applications.

 

The Bottom Line:

Under the CLARITY Act, XRP is treated as a finished product…a straightforward digital commodity used for transferring value. Flare is treated as software infrastructure; to be used freely as a commodity, it must continually prove that its governance, DeFi applications, and yield mechanics are entirely decentralized.
