SENATE’S CLARITY ACT ULTIMATUM: 60 Votes or Crypto Chaos?

On July 22, 2026, Senator Cynthia Lummis released updated text for the Digital Asset Market Clarity Act (CLARITY Act). This new draft attempts to merge the competing frameworks previously passed by the Senate Banking and Agriculture Committees into a single, cohesive bill.

Senate Majority Leader John Thune has indicated plans to bring the legislation to the Senate floor for a vote as soon as this week, creating a tight window before the Senate leaves for its August 10 recess.

Key Sticking Points

While the House passed its version with overwhelming bipartisan support in July 2025, the Senate’s path has been much more complicated. Negotiations are currently snagged on two critical issues:

The Stablecoin Yield Debate: The Senate Banking Committee’s draft prohibited crypto platforms from paying yield or rewards on stablecoin deposits, effectively treating them like traditional banks. Crypto advocates argue this protects incumbent banks from competition. The new text attempts a compromise, but it remains a primary point of tension.
Ethics and Enforcement Rules: The updated draft includes new ethics provisions for public officials and inter-agency coordination (specifically between the SEC and CFTC). However, several Democrats have raised ongoing concerns about how prohibitions on senior federal officials issuing digital assets will be strictly enforced.

Likelihood of Passage

The bill’s chances of passing before the August 10 deadline hinge entirely on bipartisan compromise.

To overcome a filibuster, the bill needs 60 votes, which requires securing Democratic support. While the Banking Committee version advanced in May with the help of two Democrats (Senators Ruben Gallego and Angela Alsobrooks), the broader Democratic caucus has not yet signed off on the finalized text.

If Senate leaders can hold a bipartisan coalition together over the stablecoin yield issue, the bill has a viable path. If a deal cannot be reached and a party-line vote is forced, it is highly unlikely to meet the 60-vote threshold, which would delay any major crypto market structure reform until at least mid-September.
